Please Post Any NBG Area comments here!

There is no cam. The NBG eagles continue to claim the Garden as their home. They continue to build nests which are torn down. This situation is near and dear to many of our hearts...thus, we are keeping this thread!!!

The male eagle has established a nest nearby on private property and continues to raise eaglets with his current mate. There is no cam but Eagle On Alliance follows the nest and reports on their community FB page

The Eagle On Alliance have launched a new website!!

I keep hoping that things will change and they will leave these eagles alone to nest. I just shake my head.
I have my coasters on my coffee table of mom and dad NOrfolk but do not let anyone use them :teehee: :teehee:

    ANOTHER BALD EAGLE STRUCK AND KILLED
    AT NORFOLK INTERNATIONAL AIRPORT

    Norfolk, Virginia – Eagle On Alliance (EOA) is sad to announce that yet another bald eagle was struck and killed at the Norfolk International Airport (ORF).

    Early Tuesday morning a bald eagle was struck and killed by a commercial aircraft approaching Runway 5 for landing. The eagle was struck and killed by the landing gear of the plane. There were no human injuries and the plane did not suffer any damage.

    At the moment, EOA does not know whether this eagle is associated with the Norfolk Botanical Garden (NBG) eagle pair. After numerous calls and emails to the Airport, the City of Norfolk and the agencies involved, no one will provide any information on the identity of this eagle.

    This latest eagle strike is yet another example of Airport not doing enough to keep eagles and other large birds off the runways at ORF. On April 26, 2011 a female bald eagle nesting in Norfolk Botanical Garden (Mom Norfolk) was struck and killed by a plane’s landing gear at Norfolk Airport while she was sitting at the end of a runway eating a fish after staff at ORF failed to disperse her from their runway.

    Airport records obtained by EOA under the Freedom of Information Act show that prior to the death of Mom Norfolk, ORF was only spending between $25,000 and $30,000 a year on wildlife dispersal efforts at the airport. These records also show that even after this incident, the Airport staunchly refused to increase its wildlife dispersal budget to anything over $40,000. However, even this small increase in funding for wildlife dispersal efforts has not been used to improve dispersal techniques at the Airport. Rather, those records demonstrate that all of the additional funding from the Airport has been used to fund the persistent nest removal and harassment of the eagle pair at Norfolk Botanical Garden.

    To put this into perspective, other airports spent anywhere from $114,000 to $378,000 a year for effective wildlife dispersal efforts at the airport itself. These efforts almost always include a full-time employee whose sole job is to observe and disperse wildlife on the airport’s runways.

    The Norfolk Airport has well over $150,000,000 in total assets. There is simply no excuse for the Norfolk Airport to refuse to increase its efforts on Airport property to disperse large birds when they are present on the runway. Instead of spending additional funds to insure the traveling public’s safety, the Airport has chosen to budget more than $11 million for cosmetic improvements to its lobby – including a huge skylight covering center court and marble wrapped columns. This most recent eagle death could have easily been avoided if the Norfolk Airport had a full-time employee looking for and dispersing birds. Other airports have full-time staff monitoring runways when planes are taking off and landing.

    Norfolk International Airport has millions of dollars in assets and should be able to afford one full-time person and a pair of binoculars.

    So long as the Norfolk Airport refuses to increase wildlife dispersal efforts at the Airport itself, the fate of the beloved Norfolk Botanical Garden eagle pair remains uncertain. The airport continues to fund nest removal and harassment of these birds.

    And if, in fact, the eagle that was killed Tuesday was one of the NBG pair, it only serves to further show that harassing the NBG pair for the past two years has been unsuccessful, to say the least. These eagles have been moving around the Airport looking for a safe place to build a nest. Yet, when they find a tree and built a nest, the nest is destroyed. This has happened eight times.

    If the NBG eagle pair was simply left alone and their last nest not torn down last December they would have been in that nest and not flying near the airport searching for a new nest site. The harassment of these eagles has forced them to find another tree time and time again putting them in harm’s way. Indeed, the last nest removed was just 50 yards from Azalea Garden Road – almost a mile from the Norfolk Airport runway.

    The idea that removing the nest of the NBG eagle pair will eliminate the risk of a wildlife strike at the Norfolk Airport is not supported by any evidence. If the Norfolk Airport was seriously concerned with bird strikes and passenger safety, it would increase funding for dispersal efforts at the Airport itself and not simply pay to harass one pair of bald eagles.

Some good news! Dad Norfolk and his mate (DT) were spotted together today!
February 2, 2014 — bald eagle, birds, DT, Eagle, eagleholic, nature, NBG, Nofolk, raptors

Bringing a big sigh of relief, we now know thankfully that it WAS NOT Dad Norfolk’s new mate killed at the airport Jan 28! Dad Norfolk and his mate (known as DT or Dirty Tail) were spotted together today! While a loss of any eagle is tragic, it is good to know that it wasn’t her and that this pair is intact, together and still flying free! It also shows that harassing eagles at the gardens did NOT prevent an eagle / airplane encounter at the the airport. We can only hope that the sacrifice of the female eagle who died on the runway will help to further the powers that be, to see that there are better alternatives for keeping runways safe than harassing one pair of eagles in a neighboring garden.

    NORFOLK AIRPORT AUTHORITY FILES MOTION TO DISMISS NAA AS DEFENDANT IN EAGLE ON ALLIANCE LAWSUIT

    AIRPORT AUTHORITY SUGGESTS EOA SUE CITY OF NORFOLK INSTEAD

    Norfolk, Virginia – Eagle On Alliance (EOA) has filed a complaint in Federal Court against the U.S. Fish and Wildlife Service (USFWS)and USDA’s “Wildlife Services” (USDA-WS) challenging the City of Norfolk’s latest eagle nest removal permit for Norfolk Botanical Garden (NBG), this time adding Norfolk Airport Authority (NAA) as an additional defendant. EOA’s motion to add the Airport to its original suit filed that was filed on July 3, 2013 was granted by the court.

    The Airport Authority has now filed a motion to dismiss itself as a defendant, telling the court that the Airport is only “tangentially” related to the harassment of the eagles at NBG, and that EOA should sue the City of Norfolk instead. The City of Norfolk has been informed of the Airport’s motion.

    EOA included NAA in the lawsuit after the Judge suggested that the absence of the Airport may make it harder for EOA to argue that the USFWS must explore ALL alternatives before issuing a permit for eagle nest removal, including increasing eagle detection and dispersal activities at the Airport itself. To issue a permit for nest removal at the Garden, the USFWS was required to first determine “whether there is a practicable alternative to nest removal that will protect the interest to be served” including making sure that the Airport is doing everything possible to mitigate wildlife hazards on its own property.

    NAA’s motion states that “Plaintiffs have not joined the City of Norfolk as a necessary party, and the suit should be dismissed under Rule 12(b)(7) if the City is not joined as a party.” EOA has requested that the motion be denied, pointing out that NAA started this entire controversy by complaining about the death of Mom Norfolk at the Airport in April 2011, and that it is also paying all of the expenses of WS to harass the eagles at the Garden. EOA also argues that the NAA is not doing enough to protect the flying public within its own boundaries. The Norfolk Airport Authority restated their arguments in its latest reply memorandum filed on March 5 – the matter is now fully briefed and awaiting the Court’s decision on whether the Airport will remain a defendant in the suit.

    EOA is being represented by the public interest Washington, D.C. law firm of Meyer, Glitzenstein & Crystal.

OK...Judge just issued a ruling. The USDA had petitioned the court to be removed from this litigation...Didn't work. Here's the ruling..posted today (9/9)

    JUDGE DENIES USDA’S MOTION TO DISMISS
    FROM EAGLE ON ALLIANCE LAWSUIT

    Norfolk, Virginia –Today the United States District Court for the District of Norfolk denied the United States Department of Agriculture’s (USDA’s) Motion to Dismiss Eagle On Alliance’s (EOA) lawsuit against the agency for its role in the ongoing nest removal activity and harassment of the Norfolk Botanical Garden (NBG) eagles.

    Earlier this year, the USDA asked the Court to dismiss the agency from the lawsuit, arguing that they were merely contractors hired by the City of Norfolk to perform the harassment and nest removal activity at the center of the litigation. The USDA told the Court that the City of Norfolk would continue to harass the NBG eagle pair even if the agency was not the entity doing it.

    The District Court rejected the USDA’s attempt to minimize its involvement in the ongoing nest removal and harassment activities at the Garden. The Court determined that because the USDA was conducting the activity challenged in the lawsuit, that the agency would remain a proper defendant in the case.

    EOA, a local grassroots environmental organization whose mission is to protect the two resident bald eagles at NBG, filed suit in Federal Court challenging a permit issued to the City of Norfolk by the U.S. Fish and Wildlife Service (FWS) for the harassment of the NBG bald eagle pair. EOA believes that not enough is being done on airport property to keep the flying public safe and that the FWS and USDA are required to improve wildlife mitigation measures at the airport before authorizing the harassment of federally protected bald eagles at the NBG.

    The USDA-WS is the agency tasked by the Federal Aviation Administration (FAA) through a memorandum of understanding with assessing and reducing wildlife hazards at airports. In this capacity, USDA-WS is the agency that initially told the City of Norfolk that nest removal and harassment of the NBG eagles was necessary.

    The lawsuit will proceed on the merits with both the FWS and the USDA as defendants.

    Eagle On Alliance addressed Norfolk City Council last night. Here are the remarks that were presented:

    MR MAYOR, VICE MAYOR, MEMBERS OF COUNCIL, MR. CITY MANAGER
    NORFOLK BOTANICAL GARDEN BALD EAGLE UPDATE FOR CITY COUNCIL, SEPTMBER 9, 2014

    • It has now been almost two years since the City of Norfolk authorized the removal of the first bald eagles’ nest at Norfolk Botanical Garden.

    • Since October 4, 2012, a total of nine nests have been removed from the Garden.

    • THE NBG RESIDENT BALD EAGLE PAIR REMAINS IN THE GARDEN.

    • AND TWO MORE BALD EAGLES HAVE BEEN STRUCK AND KILLED AT NORFOLK INTERNATIONAL AIRPORT JUST THIS YEAR – AN ADULT IN JANUARY AND A JUVENILE IN APRL – BOTH WERE IDENTIFIED AS TRANSIENT EAGLES.

    • The NBG resident pair is NOT protecting its territory by keeping other eagles away because it has no nest to protect just as EOA’s Eagle Expert Peter Nye* predicted.

    • It was been documented that more and more eagles are moving into and through the airport/garden area. In fact according to the airport’s own records, bald eagle sightings at the airport have increased 333%** since the City began removing NBG nests as compared to the same period prior to nest removal. This increase in eagle sightings cannot be attributed to the NBG eagles and their young as claimed by Scott Barras of the USDA-Wildlife Services. The NBG eagles have not been allowed to nest or breed in the area for the last 23 months.

    • Thousands and thousands of dollars have been paid by the Airport to USDA-Wildlife Services to harass two bald eagles at NBG and remove their nests.

    Today Judge Henry Morgan denied the USDA-WS’s motion to dismiss the agency from our federal lawsuit. The USDA-WS is tasked by the Federal Aviation Administration (FAA) through a memorandum of understanding with assessing and reducing wildlife hazards at airports. The agency clearly needs to do more at Norfolk International.

    We respectfully request that the city not apply for another permit to remove more nests at the garden. It is time to move to plan B! We request that you insist that full-time comprehensive action be taken ON AIRPORT PROPERTY to make the flying public safe from all wildlife strikes. Airplanes do not take off or land at Norfolk Botanical Garden.

    In closing, Eagle On Alliance will be hosting a Rally For The Eagles on October 4, 2014 at 11 a.m. at Norfolk Botanical Garden. We cordially invite all of you to attend. Many, many eagle fans from Norfolk, the commonwealth, the country and the world will be attending. And all of those who will be traveling here from distance for the weekend will be staying in Norfolk hotels and eating at Norfolk restaurants. They are doing this at our request.

    But we could not, in good conscience, have anyone fly into Norfolk International Airport. All who are flying in will be flying into Newport News/Williamsburg. We would like for all of you to help us change our airport policy. Help us make the Norfolk airport safe from wildlife strikes and safe for the flying public by keeping the runways clear of ALL wildlife including the NBG eagles.

He was a pioneer while working for the U.S. Fish and Wildlife Service in re-establishing bald eagles after their population declined dramatically due to DDT. This good news is finally public!! From the NBG Eagle Alliance FB page:

    The Norfolk Botanical Garden bald eagles appear to be safe and sound in a new nest outside of Norfolk Botanical Garden. Having endured two years of nest destruction and harassment, the NBG eagles have wisely chosen to build a new nest on private property where they cannot be disturbed.

    THE NEW NEST IS ON PROPERTY NOT OPEN TO THE PUBLIC AND TO PROTECT THE EAGLES FROM FURTHER HARASSMENT, THE NEW NEST LOCATION WILL NOT BE DISCLOSED.

    We have not disclosed this information to you before now for the safety of the eagles first and foremost, but also because until the last few days it was impossible to verify exactly whose nest it was. Mike Inman was able to get that magic photo that clearly shows the “dot” in Dad’s eye. Thank you, Mike!!!! It IS Dad Norfolk’s nest. As you can see, the nest is quite large and it is believed to be his “primary” nest. And the property owners support our eagles and EOA in every conceivable way.

    We are so happy to share this wonderful news with you.
    EAGLE ON DAD AND THE MISSUS!!! EAGLE ON!!!!!
