The young Heron I took to IBRRC has a compound humerus fracture. If the they can stabilize him, I believe they can take care of the break. I don't know how long he was sitting there, on the plastic bag, in the weeds, against the fence. Hopefully, he was fed by his parents. I did not do any kind of exam, which would have caused him even more stress and pain. But I could tell by the way he was holding his wing that he had a break. Know that he is in good hands now, has probably had some painkiller med, and is resting comfortably.

This is a heartbreaking story beans, but I know the little one is in good hands at Lindsay Wildlife. It seems like maybe they could have put cones up blocking those spaces. And the tree trimmers, I am sure they were following orders and it could be that their jobs might have been on the line to not follow orders. Many times employees are paid to do and not to think. Sad reality. Keep us posted.

Gigi, the babies are at IBRRC. Some may have been taken to Lindsay, but they would have been transferred when they were stabilized and they were ready to travel.

The USPS, a federal department, violated federal law when it hired the workers to trim the trees. I went back there this morning to see whether there were other chicks wandering around. I didn't see any, which doesn't mean more weren't killed by cars, people, predators, starvation, or thirst. They are good at hiding and they have been found several blocks from the nest tree.

Thanks for clarifying that for me beans. I am not familiar with IBRRC but I am sure they are in good hands there. I wonder if there will be any repercussions for the USPS or the tree trimming company. Should be, but it does not always work that way. Makes me crazy to see such inhumanity.

Rather than a heavy fine, I would like to see community service that would help the birds. For example, this company would talk to at least 100 other tree trimming services about the importance of not trimming trees when birds are nesting there. The workmen who did the actual work should be made aware that what they did was not only illegal, it was cruel. Neighbors were begging them to stop, so they absolutely knew they were harming (killing) babies. As far as the USPS is concerned, it is protected by so many layers of bureaucracy that nothing will happen. But I think the person who called the tree trimmers should be educated. The City of Oakland has no blame here. In fact, it may be one of the plaintiffs should there be a lawsuit (which I doubt, unless an entity such as Audubon brings it forward). Oakland does not cut the trees it owns during Baby Bird Season. And it requires prior notice when 25% or more of a tree is trimmed. I assume these are street trees that are trimmed for telephone wires, etc., but I am not sure which trees are included.

I may have made a mistake when I didn't pick up the second BCNR chick. He looked so healthy, and he was able to climb (or fly) up to the top of a bush. I assumed he was a fledgling, and we know to leave fledglings alone. On the other hand, he could have wandered around in a heavily trafficked area. I did go back yesterday to see if he was still there. He wasn't. I hope he either is back in the tree or has left with his parents. I just don't know. :girlsad3:

I can be persuasive when I need to be... most of the time. I also have a time-stamped picture of a dead BCNH in a garbage box under the tree. And the little guy I drove to the hospital was severely dehydrated, ataxic, with neurological issues. He was humanely euthanized. So we have proof of two birds who died.

Tuesday, May 13, 2014
OAKLAND, Calif. (KGO) -- A US Fish and Wildlife investigation has found no evidence that federally protected birds were killed outside a post office in Oakland.

There were reports that some black crowned herons were killed during tree trimming May 3 and maybe even put into a wood chipper.

US Fish and Wildlife investigated by checking video, talking to witnesses and inspecting the wood chipper.

The agency released a report saying there's no indication the birds were killed, but it's still investigating.

Thank you. We have the picture of the dead chick in the tree, I have the picture of the dead chick in the trash can, and the chick I took to the hospital had to be euthanized.

The Oakland Police stopped the trimming.

USFWS has found no evidence of the birds being put through the wood chipper. It has also found no evidence that the birds were killed as a result of the trimming. So finding a dead bird, taking a picture of it, and submitting it isn't proof:

Thanks. I read the articles but missed that the Oakland police shut it down. It is unfortunate that they could not arrive earlier. Glad you have photo proof to the contrary to what the "officials" are saying. Such a shame really, All they needed to do was to put up some cones and block the parking spots for a few weeks. I just don't understand why common sense cannot prevail.

These Baby BCNH fell out of their tree near the Oakland USPS when it was illegally trimmed on May 3, 2014. They were released at Martin Luther King Jr. Regional Shoreline Park, Oakland, a watershed popular with aquatic birds. The fifth chick is still recovering at IBRRC, but is almost ready to be released! Watch in HD on YouTube.

The babies are very fragile. I'm surprised they didn't all die when they fell from the nest tree. It was hard to film because the sun was shining on my digital camera and I could hardly see what I was looking at. Near the beginning, a bunch of motorcycles went by, very loud! I softened the sound in the video, but you will see that the birds are on high alert.
