He comments:

Officials with Fish & Wildlife tell ABC7News, "no further action is warranted regarding this incident." Herons expected to "fully recover."

OAKLAND, Calif. -- At least two birds injured last month when the U.S. Postal Service ordered trees trimmed to get rid of the birds outside its downtown Oakland location will be released in Oakland on Saturday, an International Bird Rescue spokesman said Thursday.

Five young black-crowned herons were injured May 3 when a contractor for the postal service trimmed the trees outside the post office at 201 13th St. on May 3.

Two of them will be released with a group of other orphaned herons cared for by the bird rescue at an event at Martin Luther King Jr. Regional Shoreline Park at 7001 Edgewater Drive on Saturday afternoon, bird rescue spokesman Andrew Harmon said.

The remaining three birds are still too young to release.

The contractor, who identified himself as Ernesto Pulido of Bay Point, is facing federal charges in the incident because the herons are a protected species.

Most bird species in California are protected under the Migratory Bird Treaty Act and it is illegal to disrupt their nesting. Any trimming should be done after the birds nesting season is over, according to investigators.

The investigation did not corroborate initial reports that any birds had died or that the birds had been put through a wood chipper.

The maximum sentence for the misdemeanor charges is six months incarceration and a $15,000 fine.

Pulido visited the bird rescue in Fairfield after the incident and is paying for their care, Harmon said.

"We had a very productive meeting, and we believe this incident can serve to educate the public on the consequences of tree-trimming in the spring, when nesting is in high gear," Harmon said in a statement.

Some here will be interested. If California would build desalination plants on its coasts, it would have plenty of water. The mideast uses them for about half its drinking etc water. Get on it Cali!

Southern California drought has left raptors emaciated, not breeding.
Owls, hawks and other birds of prey, nests remain empty
.
This has been going on for a while and we have seen significant declines in species
including red-shouldered hawks, golden eagles and White-tail Kites.

A contributing factor is the drastically reduced food supply of insects and small mammals that various bird species feed upon.
It is one of the worst breeding seasons on record.

Few active nests spotted, birds are just not nesting, not laying eggs.

Even though one Barn Owl egg was laid, it was abandoned by its mother because the male quit supplying her with food.
Birds are emaciated and are not exhibiting normal breeding behaviors.
They're very thin, and raptors are coming into contact with humans more often.

The drought is impacting the entire ecosystem - because of a lack of grass, which inhibits insects and small mammals from reproducing, it has reduced the supply of a variety of species, not just birds.

THANKS SHEPHERD, I HAD NOT HEARD THAT THE BIRDS AND SOME OF THE WILDLIFE WERE BECOMING EMACIATED. AND THANKS KITTENFACE FOR THAT ARTICLE ... IT SEEMS LIKE 50' ABOVE WITH PEOPLE WAKLING AND TAKING PICS WOULD NOT BE FAR ENOUGH AWAY ... TO KEEP FROM SPOOKING A JUVIE ... WONDER HOW THEY GET OUT OF THOSE OPENINGS SAFELY? It would seem that those pesky Black flies not only affect nesting Whooping cranes but also Loons. An estimated 70% of Loon nests in northern Wisconsin have been abandoned recently due to a large bloom of the simulium annulus species of black fly.
